A Catering Agreement is an agreement between two parties where a caterer or catering company agrees to provide catering services for a client. Parties: The type and details of the parties i.e. client and caterer are included under this Agreement. The Parties can be an individual, company, partnership, LLP and so on.
Details of the catering services: the details about catering services can be mentioned under this Agreement. If required, a detailed description can be mentioned under Schedule-A to the Agreement.
Menu: the food and drinks to be prepared and served for the event.
Guest details: the number and details of the guests.
Payment details: the payment calculation, due date, and method of payment.
Code of Conduct: The rules and regulations to be followed by the catering staff at the event location.
Statutory Compliance: This defines statutory compliance requirements to be followed by both parties such as minimum wages, insurance, Provident Fund, etc.
Term: The period for which the Agreement is valid and how and in what circumstances the Client and Service Provider can terminate this Agreement, notice period of termination of this Agreement, and so on are included under this clause.
Once the details are filled in, this Agreement can be printed on non-judicial stamp paper of value prescribed by the concerned state where this Agreement is executed. The Agreement can be signed by two independent witnesses who are not a party to this Agreement. The witness must be above the age of 18 years and with a sound mind.
Applicable Law
The acts and rules under the Indian Contract Act, 1872 will apply to this Agreement.
