Leave of Absence Agreement

A Leave of Absence Agreement is a document through which an employer and employee write down the terms of an extended leave from the employee's position. An extended leave doesn't need to have a particular timeline, but would generally be longer than sick time or vacation days. Leave is often taken in cases of maternity, paternity, general family leave, or for other reasons.

Although it is not strictly necessary to have a written record of the details of the leave through a formal contract, often it is desirable, to ensure both of the parties know what to expect.

Either an employee or employer can use this document when they've decided to establish the terms of an extended leave. The details of the employment will be asked about here, including the employee's position or title and how long they've worked for the employer. Then details regarding the leave will be filled in, including the specific dates of the leave, the compensation (if any) as well as the reason.

The document itself is quite simple to fill out and is straightforward and clear. After it is filled out, it should be printed and signed by both parties, then a copy should be kept with each.

Leave of Absence Agreements fall under the general category of employment and in the United States are subject to both Federal laws and state laws. For example, the federal Family and Medical Leave Act covers certain types of leave. Certain states also have their own leave laws.
