A Gift Affidavit is a document used when someone gives another person a gift, and wishes to swear and confirm that no payment is expected. It's quite a simple document. The person swearing the Affidavit is called the "affiant" or "donor." The person receiving the gift is the "recipient" or "donee."

Gift Affidavits contain only the following details:

1. Full legal name of the affiant;

2. Date of birth of the affiant;

3. Address of the affiant;

4. Full name and address of the recipient;

5. The gift;

6. The date the gift was given; and

7. The signatures.

 

How to use this document

This document can be completed by any person who gives another a gift and wants to swear to it. It can be requested by the affiant or the recipient. Sometimes, a court of law may request a Gift Affidavit as proof something was a gift. Often, these documents are used when large cash gifts or vehicles are given.

This document is easy to fill out and contains the basic information needed for a complete Gift Affidavit.

Once it is filled out, the Affidavit must be notarized, which means the affiant signs before a Notary Public, after providing valid legal identification.
