A Coworking Space Agreement is a relatively new type of document. This is because the idea of coworking spaces has only begun to emerge in the last few years. As more and more people work remotely online, communal workspaces have grown to give them a place to go during the day. A coworking space is a physical location run by a company. The company allows others to come work at the space in exchange for a fee.

This document allows the provider of the coworking space to set up terms for their clients.

These types of agreements are usually not bargained-for: in other words, a Coworking Space Agreement will not be discussed and reviewed by both parties. Instead, the provider of the coworking space decides on the specific terms they wish to have for their clients. The clients do not get a say. Then, the provider either posts the agreement in an accessible location (usually the coworking space website) or has the client sign it.

This document is different than a Virtual Office Agreement, as those generally provide for more limited working options. A Coworking Space Agreement is primarily meant to give the client a place to work. It is also different than a Commercial Lease Agreement, as that is a document to lease an empty physical commercial office space for a normal lease term.

How to use this document

This document is best used for the provider of a coworking space that is looking for an agreement for its clients. In other words, this document will not suit a client if they are looking to draft their own agreement for an informal coworking space.

In this document, many details about the coworking agreement are already filled in. Some specific questions will be asked regarding the possible uses of the coworking space, as well as its address and hours. Although this is a comprehensive document, most of the information about the agreement is already worked into the template.

When this agreement is filled out, it can be conveyed to the client in one of two ways: the provider can post it on their website, so as to be applicable to all future clients, or provide each client with a copy that they must sign.

Applicable law

Coworking Space Agreements will not be covered by any specific law, but are instead subject to general contract principles, which can be governed by both state and federal law.
