Fill out the templateThis document is a Building Construction Agreement which can be used by a property owner in its dealings with a general contractor where construction, renovations, alterations or other similar work is to be done to the property. This document outlines the identity of the Parties involved, the price for the services provided, the rights and obligations of each Party, and the start date and expected completion date of the construction. Either Party to the Building Construction Agreement may use this agreement where the service is for building, renovating, or altering a building or structure. A written agreement is beneficial to both the Builders and Clients as it acts as a blueprint that can be referred to understand all the plans for the construction to be completed.
It should be noted that a Building Construction Agreement is different from a mere Services Contract even though construction works can be categorised as a type of service. The fundamental difference is in the final work that is delivered to the client. Whereas in a mere services contract, the deliverables are not always tangible, (for example in a consulting services agreement where the deliverable is the consultation and advice given) in a Building Construction Agreement the deliverable is tangible as it is the completed building that has been constructed, altered or renovated. Hence, it is important to use a Building Construction Agreement where building works are concerned instead of using a services contract and attempting to tailor it to use for a building works.
This Building Construction Agreement should be used where the parties are operating within the jurisdiction of England and Wales.
How to use this document

This agreement includes details such as the Parties' information, their location, the address of the site where the work is to be carried out, description of the building work that the Builder is contracted to perform amongst other details. The agreement also notes when the building work is due to begin and the expected completion date of the construction, the presence of milestones, the option to change the work to be done, and where applicable, the specific dates for the occurrence of a particular event or milestone.
Once the document has been completed and the Parties have agreed to the specifics of the project, the agreement should be signed by both Parties and then keep copies of the document for their own records. Additionally, the Parties should make sure to attach any extra paperwork that is relevant to the construction project to this signed document.
