Legal Basis of My Request
In accordance with the UK GDPR, you are the data controller in respect of my personal data and as such, you have certain responsibilities in regard to the processing of my personal data.
Under Article 16 of the UK GDPR (implemented through s.46 of the Data Protection Act 2018), I have the right to have any inaccurate personal data which is held by you in relation to me rectified.
I further wish to draw your attention to the accuracy principle as contained under Article 5(1)(d) of the UK GDPR and, in particular, your obligation to keep the information up to date.
s.205 (1) of the Data Protection Act 2018 defines inaccurate, in relation to personal data, as incorrect or misleading as to any matter of fact.
Article 19 of the UK GDPR and s.48 (9) of the Data Protection Act 2018 requires that, where a controller rectifies the processing of personal data, it must notify any recipients who must similarly rectify the data.
A recipient means any natural, legal person, public authority or agency or other body to whom the data is disclosed, but it does not include a public authority to whom disclosure is or may be made in the framework of a particular inquiry in accordance with the law (Article 4 (9) of the UK GDPR and s.33 (5) of the Data Protection Act 2018).
Article 12 (3) of the UKGDPR states that a controller must provide a response to a rectification request without delay and in any event within one month of receipt of the request.
Required Action
In view of the above, I request that you do the following:
1. make the correction as highlighted above; AND
2. notify any and all recipients of the required correction.
