Letter to Replace, Repair, or Refund Defective Products

A Letter to Replace, Repair, or Refund Defective Products is used by a person or organization (the "buyer") who has bought products that were later discovered to be defective. It informs the person or organization that sold the said product or products (the "seller") of the defect and the resolution that the buyer would want.

Buyers have the right to return or exchange goods or avail of other remedies in case of hidden faults, defects or other charge that the buyer was not aware of at the time of the purchase. This letter informs the seller of said faults, defects, or other charge and gives them the opportunity remedy the situation.

How to use this document

The user should enter all the information necessary to complete the document. Once completed, the person who will sign the document should review the document and, if the information is correct, sign the same. The person who will sign the document should be the buyer. If the buyer is an organization, such as a corporation or a partnership, then a representative of the buyer should sign the document on behalf of the said buyer.

If any evidence is being provided in connection with this matter (such as a copy of a proof of payment or copies of correspondence between the buyer and the seller), the buyer should attach the same to the letter before the letter is sent.

Once the letter is signed and any relevant evidence is attached, deliver the letter and the attachments (if applicable) to the organization from which the repair, replacement, or refund is being requested.

Applicable law

Many consumer issues are covered by the Consumer Act of the Philippines (R.A. 7394) and its Implementing Rules and Regulations.

In addition, general principles of the laws of sales and contracts and obligations under the Civil Code of the Philippines may also apply.
