An Amendment to Agreement is a document used by contracting parties to amend an agreement or contract that they already have.
There are at least two agreements involved in an Amendment to Agreement: the first is the original agreement which the parties would want to amend using the Amendment to Agreement and the second is the Amendment to Agreement which, as described earlier, is used to amend the terms and conditions of the original agreement.
There is generally no limit to the number of amendments that can be done to an agreement as long as the conditions for amending the agreement are met.
The parties should first check the original agreement to see what the requirements are for amending it. This Amendment to the Agreement only requires the agreement and signatures of the parties to the original contract or their authorized representatives.
The user should enter all the information required to complete the document. Once completed, the parties (or their authorized representatives) should print at least two copies of the document, review the information in the document, and, if the information is correct, sign all copies of the same.
The parties should keep at least one (1) copy of the document and attach the same to their original copy of the original agreement.
Notarizing the document
If the parties would want to notarize the Amendment to the Agreement, the document also includes an Acknowledgment portion. Notarization of the document converts the document from a private document to a public document so that it becomes admissible in court without the need for further proof of its authenticity.
To notarize the document, the parties (or their authorized representatives) must print and sign an extra copy (a total of four copies) of the document and bring all the copies to a notary public to acknowledge that they have signed the Amendment to the Agreement freely and voluntarily. They should also present a valid I.D. issued by an official agency bearing their photograph and signature such as a driver's license or a passport, among others.
Notarizing an Amendment to the Agreement is generally optional.
Once notarized, each party should keep at least one (1) copy of the notarized document, as described above, and the notary public will also keep one (1) copy for their notarial book.
The law on contracts and obligations, as well as the applicable law to the original agreement, applies to the Amendment to the Agreement.
