Select the name of the type of leave that the employee wants to claim, whether maternity leave, paternity leave, parental leave, or gynecological leave (leave under the magna carta of women). These are special types of leaves granted by laws to which an employee may be entitled under certain circumstances. Choose the first option if the employee is a man seeking paternity leave as when he is married to a woman who is pregnant or has given birth. Under the Paternity Leave Act, a married male employee may claim Paternity Leave if his wife underwent delivery or miscarriage. He is guaranteed seven (7) days of leave with full pay provided that certain requirements are complied with. Choose the second option if the employee is pregnant and wants to claim maternity leave. Under the Expanded Maternity Leave Act, a female employee who is pregnant may claim Maternity Leave which guarantees them one hundred and five (105) days of leave. If the female employee suffers a miscarriage, she is entitled to sixty (60) days of leave. In both cases, she is entitled to an additional fifteen (15) days if she is unmarried or single.In which case, a Maternity Leave Request may be used instead of this letter. Choose the third option if the employee is who has previously applied for maternity leave and wishes to extend her leave. In which case, a Notice for Additional Maternity Leave may be used instead of this letter. This letter is not applicable to sick leave, vacation leave, service incentive leave (statutory 5-day leave for regular employees), or other types of leaves granted by the employer. In which case, a Leave Request from Employee may be used instead of this letter.

I am writing to formally apply for paternity leave due to my spouse's pregnancy, and I intend for my leave application to start on ________.

I am claiming paternity leave pursuant to R.A. 8187 or the Paternity Leave Act which entitles me to claim seven (7) days of leave with pay beginning on the date mentioned above, and I am compliant with the requirements of the said legislation. Specifically, my claim for leave is within the first four pregnancies of my spouse, I have timely sent this notice within a reasonable time before my spouse's expected date of delivery which is on ________, and I am currently living with my spouse.

I will use the days of my leave to attend to my spouse's needs during her recovery and in the nursing of our child.

Attached herewith is a medical certificate issued by my spouse's physician with the proof of my spouse's pregnancy showing that my spouse's expected date of delivery is on ________.
