Tenant's Request for Landlord's Permission to Sublet

This letter is used to request a landlord's permission to sublet the rental property. A sublet is when a tenant leases a part of their entire rental property to a third party, known as the sublessee or subtenant. In some cases, tenants may be required to obtain permission from the landlord before subletting the property. This is because the landlord should be informed about any new tenant in their rental property and allow the landlord to vet the proposed new tenant to ensure that the tenant does not bring an irresponsible tenant to their property.

Therefore, before subleasing the rental property, the tenant must notify their landlord in advance about their intention to sublet the property in writing by sending this document to obtain the landlord's approval. In this document, the tenant will state:

• the name and address of the sublessee; and

• specify the proposed date the sublessee will be moving into the property.

Please note that this document should not be used to seek landlord's approval to transfer or assign a lease as the Tenant's Request to Assign Lease is available for that purpose.

How to use this document

This is a simple document that requires basic information, such as the name and address of the tenant making this request, the name and address of the landlord or property manager, who is the recipient, the name and address of the 'proposed tenant, and the proposed date the sublessee would move in.

After completing this document, it should be printed, signed by the tenant sending this letter, and sent to the landlord or the landlord's attorney or authorized agent. Alternatively, this document may be downloaded and signed electronically and sent by email. The tenant should keep a copy of this document for record purposes.

Applicable Law

Tenancy agreements are subject to laws of various states in Nigeria. In Lagos State, the following laws are applicable:

• The Tenancy Law, 2011: The law regulates the right and obligations under tenancy agreements. The law is applicable to all parts of Lagos, except Apapa, Ikeja GRA, Ikoyi and Victoria Island.

• Land Use Charge Law: The land use charge is a property tax that property owners are expected to pay.
