A Notice of Violation of Lease is a document that informs a tenant about a violation of their lease agreement. At the commencement of the lease, both the tenant and the landlord enter an oral or written lease agreement to regulate their relationship. If the terms of the agreement are violated by the tenant, it can be a ground for eventual ejection.

This document serves as proper documentation of a tenant's conduct and is sent before sending a Notice to Quit, which is the first legal notice that commences an ejection process. The following information should be included in this document: the details of the tenant's actions constituting the violation of their lease; the portion of the lease that prohibits such violation; and the period in which the tenant must discontinue the infringing conduct.

However, if the tenant is late in making rent payments, a Late Rent Notice should be issued to the tenant instead. Also, if the landlord wants to terminate the tenancy outrightly, a Notice to Quit is the appropriate document to use.


How to use this document

This document can be used in both Commercial and Residential Leases to notify a tenant of their lease violation.

In this document, the basic information required are: the names and addresses of the landlord and tenant, the description of the violation, a portion of the contract prohibiting the violation, which will be entered by the party filling this document.

After completing the document, the document should be signed by the landlord and delivered to the tenant. A copy of the letter should be kept for record purposes.

Applicable law

Tenancy agreements in Nigeria are subject to individual laws of each state in Nigeria. For example, the Tenancy Law of Lagos, 2011 is only applicable in Lagos State.
