Landlord's Damages Claim Letter

The Landlord's Damages Claim Letter is a document used by a landlord to request money for the damages done to their property.

This document follows a Securities Deposit Return Letter to request additional money to cover the cost of repairs for the damage the tenant caused in their rental property.

Usually, the landlord requests a security deposit, which is paid at the beginning of the lease as insurance to cover damages or unpaid rent. However, when the tenant causes damage to the landlord's property, the landlord may demand money from the security deposit to repair the property that the tenant damaged.

This letter typically outlines the specific damages, the cost of repairs or replacements, and a request for payment or deductions from the tenant's security deposit to cover these expenses. It serves as a formal record of the landlord's claim and can be used as evidence in case of a dispute or legal action.

How to use this document

The landlord should send the letter right after they become aware of the damage from the tenant. Typically, the landlord should send this letter before returning the security deposit to ensure that the necessary deductions can be communicated to the tenant.

After sending this document, the tenant may either make the required payment to the landlord or request a meeting with the landlord. Note that if the tenant fails to comply, the landlord can file a claim in court.

Applicable law

There are no specific laws regulating the form and content of this document. However, the Tenancy Laws of the various States in Nigeria apply to this document. The Lagos State Tenancy Law, 2011, which apply to every part of Lagos State, excluding the following places: Ikoyi, Ikeja GRA, Victoria Island and Apapa also regulate landlord and tenant relationship, including security deposit payments.
