The Lease Amendment Agreement is a document that amends a lease agreement. This document seeks to add, remove, or change specific clauses in the lease agreement. When a landlord agrees to let a rental property to their tenant at the initial stage, the parties sign a Residential Tenancy Agreement or Commercial Lease Agreement. However, if the parties want to alter some provisions of their agreement, they can do so with this Lease Amendment Agreement.

Therefore, this document provides a convenient way to change terms of an original lease agreement without revoking or cancelling the entire agreement as it serves as an addendum or supplement to the original agreement. Note that this document can only be used to amend a lease agreement. However, to modify an employment contract, the Employment Contract Amendment is available for download. Also, to vary terms of any other contract, the Contract Amendment should be used.


How to use this document

The first step is to identify the provisions of the original contract that should be modified. After that, all the required information should be specified in this document. The information required includes the full names and addresses of the landlord and the tenant and description of all the clauses and provision that will be added, removed, and/or changed.

After completing the document, it should be printed, and copies of this document should be signed by the landlord and the tenant.

If one of the parties is a Nigerian company, the document should be signed by either two directors of the company or one director and one company secretary. If one of the party is a business name, incorporated trustee or other registered organization, the document should be signed by one officer of the organization.

Each party should keep one signed copy for record purposes.


Applicable law

The following laws apply to leases and tenancies in Nigeria:

  • Tenancy Laws of various States. It outlines the obligations of parties to a lease;
  • Rent Control and Recovery of Premises Act and Laws of various States. This provides the procedure a Lessor or landlord must adopt in recovering of his demised premises. The procedures are primarily to protect the interest of Lessee against the Lessor;
  • Land Instrument Registration Act and Laws of various States. This relates to the registration of instruments relating to Land in Nigeria;
  • Land Use Charge Laws;
  • Property and Conveyancing Laws;
  • Conveyancing Act.
