A Tenant's Notice to Terminate Tenancy is a letter that can be used by a tenant to inform the landlord that they intend to end a tenancy and leave the rental property. Some tenants may decide to vacate the property before the expiration date, and in some other cases, some tenants may, for some reason, be unable to leave the property even when the tenancy has already expired. Therefore, a tenant should use this document to notify the landlord of the date they will be vacating the property to avoid disputes with the landlord.

This document enables a tenant to give the necessary notice, request the deposit to be repaid by a preferred method, and resolve outstanding issues such as the date they will be vacating the property.

If the lease contains a provision requiring a notice period, the tenant must comply with this period unless the landlord allows otherwise.

There are two different forms of tenancies under Nigerian law. The most popular ones are as follows:

  • Periodic lease or tenancy: This is a tenancy that has a commencement date but no expiration date. The tenancy continues until it is either terminated by the tenant or the landlord upon the issuance of a written notice. The forms of periodic tenancies are weekly tenancies, monthly tenancies, yearly tenancies, quarterly tenancies, and so on. Here the landlord can terminate the lease by issuing a Notice to Quit, and the tenant can use this document to end the tenancy.
  • Fixed-term lease or tenancy: This tenancy lasts for a specified period, and once this period expires, the tenant is required to vacate the premises except the tenant exercises the option to renew.

Note that this document can be used in both Commercial and Residential leases.


How to use this document

After filling this form, the tenant must sign this document and deliver it to the landlord or his/her agent. It is also necessary for the tenant to keep a copy of the letter for record purposes.
