What is a Remote Work Policy?

A Remote Work Policy is a document used by Employers to outline general rules and procedures for employees who work remotely outside their physical office location, typically from their homes. This policy outlines the special rules, responsibilities, and other conditions while working remotely as the employer will have lesser control over the employees.

With the change in scenarios, more organizations are letting their employees work remotely. This Policy can be used by any type of organization including a company, LLP or partnership on a temporary or permanent basis.

What is the difference between a Remote Work Policy and a Remote Work Agreement?

A Remote Work Policy outlines the general rules while working from home or remotely and applies to every employee working remotely.

A Remote Work Agreement creates a legally binding contractual agreement as part of employment between an employee and employer. A Remote Work Agreement applies to individual employees and explains the ordinary place of work will be the employee's home.

Is it mandatory to have a Remote Work Policy?

No, it is not mandatory. However, having a Remote Work Policy helps to prevent misunderstandings and ensure both the employer and employee are aware of their responsibilities while doing remote work.

What can be the duration of a Remote Work Policy?

The Remote Work Policy can be for an indefinite period or on a conditional basis such as during the period or an emergency as mentioned in the policy.

What has to be done once a Remote Work Policy is done?

Once the policy is drafted, it can be circulated to the employees through electronic medium or in physical copies. The organization may ask the employees to acknowledge this policy and send it back for record purposes.

It is always better to make the policy accessible to all employees of the organization and update them whenever there are any changes made to this policy.

What must a Remote Work Policy contain?

This Remote Work Policy covers the following important areas:

  • Category of Employees: The category of employees eligible to work remotely.
  • Compensation: Any changes in compensation paid to the employees while working remotely.
  • Schedule and overtime rules: This includes whether the employees are allowed to work with flexible timings or not and the check-in and check-out rules of the organization.
