The Power of Attorney Resignation Letter ("Letter") is a formal and legal document used by an Attorney to resign from their responsibilities under a Power of Attorney Agreement.

The person giving authority under a Power of Attorney is called the "Principal" and the person acting on behalf of the Principal is called the "Attorney".

The Power of Attorney is a document used by a person to plan their future and decide who will take decisions on their behalf to manage their affairs in their absence or inability to act.

This Letter can be used for resigning from any type of Power of Attorney including General Power of Attorney and Power of Attorney for Property.

An Attorney usually resigns from his position in the event of an Attorney's temporary or permanent illness or disability, conflict of interest, relocation to another location, etc. The Attorney can immediately resign upon serving this letter or on a later date mentioned in the letter. However, it is expected that the Attorney would serve a reasonable notice period before resignation to provide the Principal with enough time to find a suitable replacement.


How to use this document?

This Letter can be used by an individual attorney, group of attorneys, or entity acting as an Attorney. Before preparing this Letter, the contents of the original Power of Attorney required to be reviewed to ensure compliance with its contents such as notice period, effective date, resignation procedures, etc.

Once prepared the Letter should be sent to the principal via registered post with acknowledgement receipt or to the email.

Also, a copy needs to be served to all involved parties including banks, institutions, and entities where the Attorney represents the Principal under the Power of Attorney.

It is better to publish the resignation in a local newspaper to inform the general public and other stakeholders regarding the resignation. If required, legal advice can be sought to effectively resign from the responsibilities as an Attorney. To have strong legal support this Letter can be notarized by a public notary.

 

Applicable law

The general rules of the Powers of Attorney Act, of 1882 and the Indian Contract Act, 1872 will be applicable here.
