Late Rent Notice

A Late Rent Notice is used by a Landlord or Property Manager when a Tenant is late in making a rent payment. A Late Rent Notice contains the date and duration rent was due, and any late charges for the late payment. A Late Rent Notice is often the first step in a Landlord's attempt to evict a Tenant who habitually fails to pay their rent on time.

How to use this document?

The Landlord can use this document to remind a Tenant that their rent is due and give them notice of late payment prior to escalating the matter to eviction or other serious legal action. The Notice includes information for identifying the landlord and tenant, details about the property and lease agreement, including the address of the rental property, as well as the late charges as dictated by the lease. The notice can be sent in respect of a residential lease pursuant to a residential lease deed or a commercial lease in terms of a commercial lease agreement.

Once the Late Rent Notice is complete, it is sent by registered mail, to create a record that the letter was sent and received by the Tenant. This record may be useful in case of future legal action, such as an eviction action.

Applicable law

There are no laws outlining specific requirements that a Landlord sends a Late Rent Notice. A Late Rent Notice can be a helpful interim action prior to instigating serious legal action and getting the Court involved. However, the provisions of the Transfer of Property Act, 1882 and in some cases state rent control acts would be applicable in respect of a lease of premises.
