Babysitting Agreement

The Babysitting Agreement is a document that can be used by parent(s) and guardian (hereafter referred as the 'Client') who are availing the babysitting/nanny service for their child/children at their home residence.

This Agreement can be used by an individual providing babysitting services (hereinafter referred as the 'Nanny') who is a self employed or an independent contractor. It means that this Agreement does not create any employment relationship between the Client and the Nanny. The Nanny is responsible for filing own income tax and other taxes if any. If the parties wish to establish an employment relations between them, in this case the Employment Contract should be used instead.

For an individual providing childcare services or an institution like a crèche, kindergarten or nursery, a separate Childcare Agreement is available on the website.

For purposes other than for babysitting or childcare services, a general template on Services Agreement is also available on this website.

This Agreement will help both parties to clarify the agreed terms and avoid any disputes in the future.

How to use this document?

The Agreement includes the details of the Client, who are parent(s)/guardian and the Nanny, and the details of the children/child to whom this Agreement is applicable. The carefull thougth should be given to the following details:

• details of services and meals provided;
• location of service;
• schedule of the service;
• responsibilities of each party;
• privacy of the child.

Once the document is filed, it can be printed on a non-judicial stamp paper of value prescribed by the concerned state and can also be notarized. A copy can be given to the Nanny. A copy also needs to be kept with the Client (parent(s)/guardian) for any future reference.

Applicable law

The Babysitting Agreement will be covered under the Indian Contract Act, 1872.
