WHEREAS Client desires to engage the Service Provider to perform the dog walking service herein described, hereinafter referred to as "Dog Walking Service"; and
WHEREAS Service Provider is willing to be engaged by the Client and possesses the skill necessary to perform the Dog Walking Service described herein.
NOW, THEREFORE in consideration of the following terms, conditions and promises of the Parties, Client and Service Provider covenant and agree as follows:

4. GENERAL RESPONSIBILITIES OF THE SERVICE PROVIDER
4.1. The general responsibilities of the Service Provider include:

4.1.2. To alert the Client immediately if there are any issues at the Service Location.
4.1.3. To take care of basic needs for the including hygiene, food, and drinks.

4.1.5. To notify the Client with reasonable notice, if for any reason the Service Provider cannot provide the Service on certain days.
4.1.6. To prepare and/or provide healthy foods. The food shall be served at the scheduled time every day.
4.1.7. To exercise all precautions against sickness, injury, escape, loss, accidents or death of. The Service Provider is not responsible for sickness, injury, escape, loss accidents, or death of unless caused through negligence or willful misconduct on the part of the Service Provider.
4.1.8. To clean up the play and the living area of the.

4.1.11. To keep a clean and safe environment.
4.1.12. To be punctual with the Dog Walking Service schedule and occasionally stay late to help with unforeseen issues.

4.1.14. To make every reasonable effort to avoid loss or damages to the 's belongings however the Service Provider will not be responsible for any loss or damage to such items.

4.1.17. To accompany the Client while travelling outside with the during duty time. The Service Provider shall also accompany the Client while travelling abroad with the. The Service Provider will be provided with the food and accommodation facility during such trips. The Dog Walking Service Charge payment during international trips will be as mentioned under the Service Charge and Payment clause of this Agreement.
4.1.18. The travel arrangements including the visa and other documentation will be arranged by the Client. The Service Provider will have free time during the international trips and during the free time, the Service Provider is free to go outside with the permission of the Client.
4.1.19. The Service Provider is solely responsible for any payments to the Service Provider's employees, agents, or subcontractors including any payments of salary, wages, etc.
5. GENERAL RESPONSIBILITIES OF THE CLIENT
5.1. The general responsibilities of the Client include:
5.1.1. Make the payments on time.
5.1.2. Arrange all necessary arrangements for the Service Provider to smoothly take care of the.
5.1.3. Provide basic food and drinks to the Service Provider.
5.1.4. Provide basic amenities like access to the washroom, kitchen, etc.
5.1.5. The Client will arrange a room and stay facility for the Service Provider.
5.1.6. The Client will reimburse any reasonable costs such as for transportation, food and supplies purchase, medicine, etc. incurred by the Service Provider while providing Dog Walking Service to the upon submitting valid proof.
5.1.7. Client agrees to notify the Service Provider of any concern within 24 hours of completion of Services.
5.1.8. Client represents and warrants that currently vaccinated in accordance with all local, state and central laws and regulations.
5.1.9. Client accepts responsibility for all medical expenses and other damages resulting from an injury to the Dog sitter, other persons or other animal(s) caused by the Client's or negligent act.
5.1.10. Client agrees to indemnify, hold harmless and defend Service Provider in the event of a claim by any person injured or otherwise damaged by or negligent act.
5.1.11. Client agrees to authorize Service Provider to enter the Client's listed address as needed to perform agreed-upon Services.
5.1.12. Before leaving the premises, the Client agrees to ensure the home or premises are properly secured. The Service Provider shall not be held liable for any burglary or other crimes unless there is direct involvement of the Service Provider or its personnel in such acts.
5.1.13. Client is responsible for supplying the necessary equipment and supplies needed for the care of their including, but not limited to a sturdy, well-fit harness or collar and leash for walks, Dog food, medications, identification tags, litter boxes, and cleaning supplies.
5.1.14. Client authorizes the use of pictures on the website, social media and/or marketing materials for promotional purposes by Service Provider.
6. ILLNESS
6.1. The Client shall always notify the Service Provider of any symptoms or signs of disease on the in advance.
6.2. If the display any symptoms or conditions below, the same shall be communicated to the Service Provider in advance and the Service Provider at his/her discretion may provide the Dog Walking Service during the period of illness:

6.2.2. Vomiting and Diarrhoea
6.2.3. Skin rash or eruptions of any unknown origin
6.2.4. Arthritis
6.2.5. Fleas and Ticks
6.2.6. Worms
6.2.7. Communicable diseases (e.g., Canine Provovirus, Rabies, Lyme Disease, etc.).
6.3. The Service Provider shall always notify the Client of any symptoms or signs of disease in advance.
6.4. If the Service Provider displays any symptoms or conditions below, the same shall be communicated to the Client in advance and the Client at his/her discretion may allow providing the Dog Walking Service during the period of illness:
6.4.1. Fever
6.4.2. Vomiting
6.4.3. Skin rash or eruptions of any unknown origin
6.4.4. Persistent cough
6.4.5. Heavy nasal discharge
6.4.6. Diarrhea
6.4.7. Pink Eye
6.4.8. Sore Throat
6.4.9. Upset Stomach
6.4.10. Communicable diseases (e.g., chicken pox, measles, ringworm scarlet fever, etc.).
7. ABSENCE OF SERVICE PROVIDER
7.1. If the Service Provider is planning to take a break from Dog Walking Service, such a decision shall be communicated to the Client with advance notice of ________ (________).
7.2. No Service Charge will be levied during the leave days of the Service Provider.
8. MEDICAL CARE
8.1. The Client gives the following medical consent to the Service Provider:
8.1.1. The Service Provider has the authority to administer medication to the when it is required.
8.1.2. In the event of an emergency, the Service Provider will make every attempt to contact the owner or an emergency contact. In the event that no contact can be reached, the Service Provider can seek appropriate medical care for and/or take the to the veterinary hospital in the event of a medical emergency. The maximum amount that is reimbursable in case of a medical emergency to the Service Provider is Rs ________ (________).

9. NOTICES

11. SERVICE CHARGE AND PAYMENT

13. LIABILITY
13.1. If the Service Provider is found to be violating any animal rights under the Prevention of Cruelty to Animals Act, 1960, they will be held liable for any fines or punishments. Additionally, the Client reserves the right to terminate this Agreement and/or claim damages from the Service Provider.
13.2. To the maximum extent permitted by law or statute, except for the Client's statutory rights, and Service Provider expressly disclaims all warranties of any kind.
13.3. The Client hereby agrees that the Client is solely responsible for determining whether the Services are fit for the Client's purpose.
13.4. The Service Provider's liability for any loss, injury, or death of the during or as a result of the Service shall be limited to cases of gross negligence or intentional misconduct.
14. TERM AND TERMINATION
14.1. This Agreement will commence from ________.
14.2. The Service will be provided unless either Party terminates this Agreement in accordance with this Agreement.

15. DISPUTE RESOLUTION
15.1.The parties hereby irrevocably consent to the exclusive jurisdiction and venue of any court of competent jurisdiction within such jurisdiction with respect to any dispute, controversy, or claim arising out of or relating to this Agreement.
15.2. If either Party employs attorneys to enforce any rights arising out of or relating to this Agreement, the prevailing Party shall be entitled to recover reasonable costs and attorneys' fees.

Both the Parties agree that by reason of the Service relationship, either Party had or may have access to the confidential information of the other Party ("Confidential Information"). Both the Parties agree that after entering into this Agreement, he/she will not directly or indirectly use or divulge such confidential information for any reason and agree to return or destroy as advised by the disclosing Party within a reasonable time.
18. INDEPENDENT CONTRACTOR
The Parties involved in this Agreement are independent and do not establish any employment relationship, partnership, joint venture, or any other relationship, except for that of an independent contractor.
19. GOVERNING LAW
This Deed shall be governed by the laws of India and Andaman and Nicobar Islands.

15.1.The parties hereby irrevocably consent to the exclusive jurisdiction and venue of any court of competent jurisdiction within such jurisdiction with respect to any dispute, controversy, or claim arising out of or relating to this Agreement.
15.2. If either Party employs attorneys to enforce any rights arising out of or relating to this Agreement, the prevailing Party shall be entitled to recover reasonable costs and attorneys' fees.

17. CONFIDENTIAL INFORMATION
Both the Parties agree that by reason of the Service relationship, either Party had or may have access to the confidential information of the other Party ("Confidential Information"). Both the Parties agree that after entering into this Agreement, he/she will not directly or indirectly use or divulge such confidential information for any reason and agree to return or destroy as advised by the disclosing Party within a reasonable time.
18. INDEPENDENT CONTRACTOR
The Parties involved in this Agreement are independent and do not establish any employment relationship, partnership, joint venture, or any other relationship, except for that of an independent contractor.
19. GOVERNING LAW
This Deed shall be governed by the laws of India and Andaman and Nicobar Islands.
