BABYSITTING AGREEMENT
This Babysitting Agreement ("Agreement") is signed on ________ at Andaman and Nicobar Islands.

WHEREAS Client desires to engage the Nanny to perform the Babysitting herein described; and
WHEREAS Nanny is willing to be engaged by the Client and possesses the skill necessary to perform the Babysitting described herein.
NOW, THEREFORE in consideration of the following terms, conditions and promises of the Parties, Client and Nanny covenant and agrees as follows:
1. DETAILS OF THE CHILD

2. FEE AND PAYMENT
a. The fee for babysitting is Rs ________ (________) per hour.
b. The payment to the Nanny will be made on a daily basis.
c. The payment shall be made in the following manner: Bank transfer. Any applicable bank charges shall be borne by the Client.
d. The aforementioned fee amount includes any and all taxes required by state and local laws.
e. If the Client intends to take their Child on vacation or otherwise does not require the Babysitting for more than one working day, then they must notify the Nanny with advance notice of ________ (________). Failure to which the Client shall be liable to make the payment for such days.

b. The Babysitting will not be provided on public holidays in India and Andaman and Nicobar Islands (paid holidays).
c. If the Client wants to make any changes to the Schedule, the same shall be intimated to the Nanny in writing, and subject to availability, the Nanny may accept the changes in schedule.
5. GENERAL RESPONSIBILITIES OF THE NANNY
a. The general responsibilities of the Nanny include:
I. To observe due care when watching the Child.
II. To alert the parents immediately if there are any issues at home.
III. To take care of basic needs for the Child including hygiene, naps, food, and drinks.
IV. To prepare and supervise activities with the Child including games, walks, reading, and outdoor activities.
V. To conduct activities that have educational and development value for the Child.
VI. To notify the parents with reasonable notice, if for any reason the Nanny cannot provide the Babysitting on certain days.
VII. To prepare healthy foods for both parents and the Child. The food shall be served at the scheduled time every day.
VIII. To help the parents in light household work.
IX. To accompany the Client while travelling outside with the Child during duty time. The Nanny shall also accompany the Client while travelling abroad with the Child. The Nanny will be provided with the food and accommodation facility during such trips. The fee payment during international trips will be as mentioned under the Fee and Payment clause of this Agreement.
The travel arrangements including the visa and other documentation will be arranged by the Client. The Nanny will have free time during the international trips and during the free time, the Nanny is free to go outside with the permission of the Client.
X. To help with homework and tutoring as required.
XI. To clean up the play and the living area of the Child.
XII. To transport the Child from and to the activities like dance class, games, and schools.
XIII. To get Child to the bed on time.
XIV. To do laundry of the Child and parents.
XV. To shower and dress the Child.
XVI. To keep a clean and safe environment.
XVII. To be punctual with the Babysitting schedule and occasionally stay late to help with unforeseen issues.
XVIII. To provide first aid whenever required.
XIX. To make every reasonable effort to avoid loss or damages to the Child's personal belongings however the Nanny will not be responsible for any loss or damage to such items.
XX. To not use any corporal punishment. Instead, the Nanny shall use methods like redirection and/or a time-out.
XXI. To not smoke or use any intoxicants on duty or off duty.
XXII. To be always caring and compassionate towards the Child.
6. GENERAL RESPONSIBILITIES OF THE CLIENT
a. Make the payments on time.
b. Arrange all necessary arrangements for the Nanny to smoothly take care of the Child.
c. Provide basic food and drinks to the Nanny.
d. Provide basic amenities like access to the washroom, kitchen, etc.
e. The Client will arrange a room and stay facility for the Nanny.
f. The Client will reimburse any reasonable costs incurred by the Nanny while providing Babysitting to the Child upon submitting valid proof.
7. ILLNESS
a. The Client shall always notify the Nanny of any symptoms or signs of disease on the Child in advance.
b. If the Child display any symptoms or conditions below, the same shall be communicated to the Nanny in advance and the Nanny at his/her discretion may provide the Babysitting during the period of illness:
I. Fever
II. Vomiting
III. Skin rash or eruptions of any unknown origin
IV. Persistent cough
V. Heavy nasal discharge
VI. Diarrhea
VII. Pink Eye
VIII. Sore Throat
IX. Upset Stomach
X. Communicable diseases (e.g., chicken pox, measles, ringworm scarlet fever, etc.).
c. The Nanny shall always notify the Client of any symptoms or signs of disease in advance.
d. If the Nanny displays any symptoms or conditions below, the same shall be communicated to the Client in advance and the Client at his/her discretion may allow providing the Babysitting during the period of illness:

11. TERM AND TERMINATION
a. This Agreement will commence from ________.
b. The Babysitting will be provided unless either Party terminates this Agreement in accordance with this Agreement.
c. Either Party may terminate this Agreement by providing ________ (________) of advance notice to the other Party.
d. The Nanny may terminate this Agreement without notice if:

e. The Client may terminate this Agreement without notice if:

f. Upon termination of this Agreement, Nanny shall no longer be entitled to compensation under this Agreement, except the payment for the Babysitting rendered and fully performed as per this Agreement prior to termination of this Agreement.
12. FORCE MAJEURE
If and to the extent that a Party's performance of any of its obligations under this Agreement, hindered or delayed by fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, pandemic, rebellions or revolutions, or any other similar cause beyond the reasonable control of such Party (each, a "Force Majeure Event"), and such non-performance, hindrance or delay could not have been prevented by reasonable precautions, then the non-performing, hindered or delayed Party will be excused for such non-performance, hindrance or delay, as applicable, of those obligations effected by the Force Majeure Event for as long as such Force Majeure Event continues and such Party continues to use its best efforts to recommence performance whenever and to whatever extent possible without delay, including through the use of alternate sources, workaround plans or other means. The Party whose performance is prevented, hindered, or delayed by a Force Majeure Event will immediately notify the other Parties of the occurrence of the Force Majeure Event and describe in reasonable detail the nature of the Force Majeure Event.
13. COFIDENTIAL INFORMATION
a. Both the Parties agree that by reason of the Babysitting relationship, either Party had or may have access to the confidential information of the other Party, including the details of the Child such as the name, address, date of birth, medical history, sex, photos, videos, etc. and confidential information of the Parties signing this Agreement ("Confidential Information"). Both the Parties agree that after entering into this Agreement, he/she will not directly or indirectly use or divulge such confidential information for any reason and agrees to return or destroy as advised by the disclosing Party within a reasonable time.
b. These obligations are in addition to any obligations the receiving Party has under the state or central laws. The receiving Party also agrees that all confidential information shall remain the exclusive property of the owner. Receiving Party recognises and acknowledges that the confidential and trade secret information is a valuable and unique asset of the disclosing Party and receiving Party to maintain the confidentiality of the trade secrets and not to disclose it, in whole or in part, to any person, firm, corporation or other entity for any reason.
c. The clause shall last indefinitely and shall survive the termination of the Agreement.
14. INDEPENDENT CONTRACTOR
The Parties to this Agreement are independent Parties and do not create any employment relationship, partnership, joint venture, or any other relationship other than that of an independent contractor.
15. GOVERNING LAW
This Deed shall be governed by the laws of India.
