A Reservist Leave is an unpaid leave of absence that an employee can take if they are part of the military and must be deployed for a Canadian Forces operation, whether in or out of Canada.

A Reservist Leave is a leave permitted under the law, and this means that an employee has the right to take this leave without losing job security.

The length of the reservist leave will depend on the duration of the military operation, or it will be based on the laws of each Province or Territory.

Each Province or Territory will have its own requirements and rules before an employee is entitled to this leave, including, for example, having worked at least 6 months under the employer.

This leave is only permitted if the employee provides written notice. Therefore, it's important to properly fill out this document and provide the employer with reasonable notice.

Also, depending on the Province, at the end of this leave, an employer may postpone an employee's return.


HOW TO USE THIS DOCUMENT

Notice of this leave should be delivered to the employer in advance before the employee takes their leave of absence. Many Provinces will normally require at least 4 weeks prior notice.

Employers are legally allowed to require evidence from the employee to prove their entitlement to take a reservist leave, which may include a certificate from the reserve force or a document approved by the Chief of the Defence Staff.

The letter can be sent by mail or email in PDF format. Once the notice has been sent to the employer, the employee should keep a copy of the letter.


APPLICABLE LAW

Employment law legislation is governed by each Province and Territory. For federal employees, the Canada Labour Code (R.S.C., 1985, c. L-2) applies. These laws establish the minimum requirements of a leave of absence that employers must afford to their employees.

The right to a Reservist Leave may also be governed by the required duties under the National Defence Act, RSC 1985, c N-5.
